Terms of Service

These Terms of Service ("Terms") govern your use of the Pour app ("Pour," "the app," "we," or "our"), developed and operated by Party On NWA LLC. By downloading, installing, or using Pour, you agree to be bound by these Terms. If you do not agree, you may not use the app.

1. Acceptance of Terms

By accessing or using Pour, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. These Terms apply to all versions of Pour, including the iOS app, Apple Watch companion, App Clips, home screen widgets, and Siri Shortcuts.

2. Age Requirement & Responsible Drinking

Pour is rated 17+ on the App Store and is intended for adults of legal drinking age. By using Pour, you represent that you are of legal drinking age in your jurisdiction (at least 21 in the United States, or the applicable minimum legal age elsewhere).

Pour is an informational and entertainment tool for mixology enthusiasts. Pour does not sell, distribute, or facilitate the purchase of alcohol. Recipes, recommendations, and AI-generated suggestions are for informational purposes only. Please drink responsibly, know your limits, and never drink and drive. Party Mode and Bartender Mode scaling features are intended for responsible event planning — use your judgment when serving alcohol to guests.

3. Pour Pro Subscription

Pour Pro is an optional subscription that unlocks additional features and higher usage limits. All subscriptions are managed through Apple's in-app purchase system.

3.1 Plans & Pricing

3.2 Free Trial

New Pour Pro subscribers may be eligible for a 7-day free trial on the monthly plan. Trial eligibility is determined by Apple's App Store. If you have previously subscribed to Pour Pro, you may not be eligible for a new free trial.

• You will not be charged during the free trial period.
• If you do not cancel before the trial ends, your subscription automatically converts to the monthly plan and you will be charged $4.99.
• To avoid charges, cancel at least 24 hours before the trial end date via your Apple ID account settings.

3.3 Billing & Auto-Renewal

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription rate.
• You can manage and cancel your subscription from your Apple ID account settings or the App Store → Subscriptions.

3.4 Cancellation & Refunds

• You may cancel your subscription at any time through the App Store.
• After cancellation, Pour Pro features remain available until the end of the current billing period.
• We do not provide refunds for unused portions of a subscription period. Refund requests must be submitted to Apple per Apple's refund policy.
• We reserve the right to change Pour Pro pricing with reasonable advance notice through the app or our website.

4. Description of Service

Pour is a cocktail reference and home bar management app. It provides, among other features:

• Recipes — Searchable library of 500+ cocktail recipes with filtering, step-by-step instructions, and AI-generated recipe images.
• Pour Decisions — Personalized swipeable pairing feed based on your taste preferences.
• My Bar — Personal bar inventory tracking with "What Can I Make?" recipe matching.
• Pour Vision — Bottle identification via on-device OCR (free) or AI photo analysis (Pro).
• Pour IQ — AI-powered bartender chat for personalized suggestions and drink questions.
• Pour Sessions — Guided technique and tasting sessions with tracked progress.
• Pour Passport — Achievement and badge system tracking your cocktail journey.
• Drink Journal — Personal log of drinks with ratings, notes, mood, and photos.
• Community Riffs — Submit and discover user-created recipe variations.
• Pour for Two (Shared Bar) — Share your bar inventory with a linked partner.
• Bartender Mode — On-device event planning, cost calculation, and menu generation.
• Video-to-Recipe Import — Paste a YouTube, TikTok, Instagram, or Facebook video link to extract a cocktail recipe using AI (Pour Pro, 5 imports/day).
• Pour Lists — Custom recipe collections with emoji icons.
• Pour Mix — AI cocktail creator: describe a drink concept in natural language and receive a generated custom recipe (Pour Pro).
• Flavor Map — On-device visual map of flavor relationships across cocktail categories (citrusy, smoky, herbal, sweet, and more).
• Ingredient Intelligence — On-device tasting notes, origin info, and pairing suggestions for spirits in your bar.
• Monthly Recap — Personalized monthly activity summary (Pour Pro).
• Taste Journey — Visual exploration of your taste preferences across spirit categories.
• Seasonal Picks — Seasonally-relevant cocktail recommendations.
• Widgets & Siri Shortcuts — Home screen widgets and Siri voice commands for quick access.
• App Clips — Preview recipes and sessions at hellopour.com without installing the full app.

Features may be added, modified, or removed at our discretion. We will make reasonable efforts to communicate significant changes.

5. Community Content (Pour Riffs)

5.1 Your Riffs Are Public

When you submit a Community Riff (a variation on an existing recipe), it becomes visible to all Pour users. By submitting a Riff, you:

• Grant Party On NWA LLC a non-exclusive, royalty-free, worldwide license to display and distribute your Riff within the Pour app.
• Represent that the Riff is your original content and does not infringe any third party's intellectual property, privacy, or other rights.
• Understand that your display name (or "Anonymous" if none is set) may be associated with your Riff when displayed to other users.

5.2 Content Guidelines

Riff content must not include:

• Profanity, obscene, explicit, or offensive language or content.
• References to illegal substances, controlled substances, or content that encourages illegal activity.
• Personal attacks, harassment, hate speech, or discriminatory content.
• Spam, advertisements, URLs, or commercial solicitations.
• Personal information about yourself or others (phone numbers, addresses, emails).
• Content that violates any applicable law or regulation.

5.3 Our Rights to Remove Content

We reserve the right to remove any Riff at any time, with or without notice, for any reason including but not limited to violation of these guidelines. Repeated or severe violations may result in suspension of your ability to submit community content or termination of your account. We are not obligated to review all submitted content before it is published, and we are not responsible for the content of Community Riffs submitted by other users.

6. Shared Bar Consent (Pour for Two)

The Shared Bar feature allows two Pour users to voluntarily link their bar inventories.

• Sharing requires explicit action: one user generates an invite code and the other enters it. Sharing is never automatic.
• By accepting a Shared Bar invitation, you consent to your bar inventory (bottle names and quantities) being visible to your linked partner, and you agree to view your partner's bar inventory.
• You may unlink your Shared Bar at any time from My Bar → Shared Bar → Unlink. Unlinking immediately ends all shared visibility.
• We are not responsible for how your partner uses or acts upon information about your bar inventory.
• Do not share your bar inventory with users you do not know or trust.

7. AI Features & Disclaimer

Pour includes AI-powered features provided for informational and entertainment purposes only. AI-generated content may not always be accurate, complete, or up to date.

7.1 Pour IQ (AI Chat)

• Pour IQ is powered by Anthropic's Claude API. Responses are AI-generated and are not a substitute for professional advice from a licensed bartender, sommelier, nutritionist, or medical professional.
• Allergen Warning: Recipes and suggestions may contain allergens. Always verify all ingredients if you or your guests have food allergies, dietary restrictions, or medical conditions.
• Recipe accuracy is not guaranteed. Always use common sense and standard safety practices when preparing and serving drinks.
• Pour IQ is intended for mixology-related topics only. Using it for unrelated purposes may result in degraded or irrelevant responses.
• Chat history is stored locally and can be deleted at any time from Settings → Chat.

7.2 Pour Vision Photo Analysis (Pro)

• Photo Analysis uses Anthropic's Claude Vision API to identify bottles from images. Results may not always be accurate. We do not guarantee the correctness of any bottle identification.
• Photos are processed via our server and the Anthropic API and are not stored after the identification response is returned.
• Photo Analysis is available to Pour Pro subscribers only. Live Scan (on-device OCR) is available to all users.

7.3 Video-to-Recipe Import (Pro)

• Video-to-Recipe Import uses Anthropic's Claude API to extract cocktail recipes from publicly available video transcript text. Results may not always be accurate or complete. Always review and verify the extracted recipe before saving.
• We do not guarantee that any video URL will contain a valid cocktail recipe, that the transcript will be available, or that the extraction will succeed. The 5-import daily limit is consumed whether or not extraction succeeds.
• This feature processes only the publicly available text metadata of the video (transcript, description). We do not download or store the video file itself.
• Use of this feature is subject to the terms of service of the video platform whose content you are importing. You are responsible for ensuring your use complies with those platforms' terms.
• Video-to-Recipe Import is available to Pour Pro subscribers only. Limit: 5 imports per day.

7.4 Pour Mix (AI Cocktail Creator — Pro)

• Pour Mix uses Anthropic's Claude API to generate custom cocktail recipes from your text prompts. Results are AI-generated and may not always be accurate, practical, or suitable for your preferences. Always review a generated recipe before preparing it.
• Recipe accuracy is not guaranteed. AI-generated ingredient quantities, techniques, and flavor descriptions are suggestions only. Use your judgment and standard safety practices when preparing drinks.
• Allergen Warning: AI-generated recipes may include allergens. Always verify all ingredients if you or your guests have food allergies, dietary restrictions, or medical conditions.
• Ownership of saved recipes: When you save a Pour Mix–generated recipe, you own the saved content as a custom recipe in your account. Party On NWA LLC does not claim ownership over recipes you generate and save. You grant us a limited license to store and sync your saved recipes as part of your account data.
• Recipe images associated with Pour Mix recipes may be AI-generated (see Section 7.5). They are for illustrative purposes only.
• Pour Mix is available to Pour Pro subscribers only.

7.5 Recipe Images (AI-Generated)

• Cocktail recipe images displayed in Pour are AI-generated using Google's Imagen 4 model. They are produced by us during app development and are not photographs of actual drinks.
• Images are for illustrative and inspirational purposes only. They may not accurately represent the appearance of a finished cocktail.
• We make no warranty that recipe images depict the correct glassware, garnish, color, or presentation for any given cocktail.

8. Usage Limits & Fair Use

To maintain a quality experience and manage infrastructure costs, Pour enforces the following limits:

These limits may be adjusted at our discretion with reasonable notice. Attempts to circumvent usage limits — including the use of multiple accounts, bots, or automated tools — may result in suspension of the affected features or termination of your account.

9. Accounts & Cloud Sync

Pour offers optional account creation to enable cloud backup and cross-device sync. By creating an account, you agree:

• You must provide a valid email address, or sign in with Apple or Google.
• You are responsible for maintaining the security of your account credentials.
• Your synced data is stored and processed as described in our Privacy Policy.
• Account creation is optional. Pour is fully functional without an account (data is stored locally on your device only).
• You will not create multiple accounts to circumvent usage limits or access restrictions.

10. Account Deletion

You have the right to delete your account at any time.

• Go to Settings → Account → Delete Account within the Pour app.
• Deletion permanently removes all data associated with your account from our servers (27+ database tables) within 30 days.
• Local data stored on your device (SwiftData) is also cleared upon account deletion.
• Account deletion is permanent and cannot be undone. Make sure to export your data first if you wish to keep a copy (Settings → Export My Data).
• Deleting your account cancels your access to Pour Pro features, but does not automatically cancel your App Store subscription. Cancel your subscription separately through Apple ID account settings to stop future billing.

11. Push Notifications

Pour offers optional push notifications. They are strictly opt-in — you will never receive notifications without granting permission. Notification types include recipe unlock alerts, weekly cocktail suggestions, and trial expiring reminders. You can manage or disable notifications at any time from iOS Settings or within Pour Settings.

12. Acceptable Use

You agree to use Pour only for its intended purpose. You may not:

• Allow anyone under the legal drinking age to use the app.
• Reverse engineer, decompile, or disassemble any part of the app.
• Use automated tools, bots, or scripts to interact with the app or its backend.
• Attempt to circumvent usage limits, rate limiting, security measures, or access controls.
• Submit Community Riffs that violate the content guidelines in Section 5.
• Misuse the Shared Bar feature to access data of users who have not consented to sharing.
• Use Pour for any unlawful purpose or in any way that could harm other users.

13. Intellectual Property

The Pour app, including its design, branding, graphics, animations, video content, and original written content, is the intellectual property of Party On NWA LLC. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

Cocktail recipes are generally not subject to copyright. However, the specific descriptions, presentation, curation, and organization within Pour are protected intellectual property. Ambient video backgrounds, UI design, and brand assets may not be reproduced without written permission.

Pour Mix — User-Generated Recipes: When you save a recipe generated through Pour Mix (our AI cocktail creator), the saved recipe belongs to you. Party On NWA LLC makes no claim of ownership over custom recipes you generate and save. You grant us a limited, non-exclusive license to store, sync, and display your saved recipes within your Pour account. AI-generated recipe images displayed alongside Pour Mix results are produced by us and remain our property; your ownership extends to the recipe text and ingredient data you save, not the visual assets.

14. Apple End User License Agreement

Pour is distributed through the Apple App Store. Your use of Pour is also subject to Apple's standard End User License Agreement (EULA). By using Pour, you acknowledge that you have read and agree to Apple's EULA, available at:

Party On NWA LLC, not Apple, is solely responsible for Pour and its content. Apple has no obligation to provide maintenance or support for Pour.

15. Disclaimer of Warranties

Pour is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not warrant that:

• The app will be error-free, uninterrupted, or free of security vulnerabilities.
• Recipes, AI suggestions, bottle scanner results, or pairing recommendations will be accurate, complete, or suitable for your needs.
• AI-generated content from Pour IQ or Pour Vision will always be correct or appropriate.
• Scaled recipe quantities in Bartender Mode will be precise for all serving sizes.
• Push notifications or emails will be delivered reliably or on time.
• The app will be compatible with all iOS devices or operating system versions.
• Cloud sync will be available at all times.

16. Limitation of Liability

To the maximum extent permitted by applicable law, Party On NWA LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Pour, including but not limited to damages for personal injury, property damage, or lost data.

Our total liability for any claims arising from your use of the app shall not exceed the amount you paid for Pour Pro in the twelve (12) months preceding the claim, or $10.00 USD if you have not paid any amounts.

17. Indemnification

You agree to indemnify, defend, and hold harmless Party On NWA LLC and its members, officers, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from: (a) your use of the app; (b) your violation of these Terms; (c) Community Riffs or other content you submit; or (d) your violation of any third party's rights.

18. Third-Party Services

Pour integrates with third-party services, each subject to its own terms and policies:

• Supabase — Cloud database, authentication, and Edge Functions. Supabase Terms
• Anthropic (Claude API) — Pour IQ, Pour Vision Photo Analysis, Video-to-Recipe Import, and Pour Mix. Anthropic Terms
• Google (Imagen 4) — AI generation of cocktail recipe images (used by us during app development; not called at runtime). Google Terms

• Apple — MapKit (Store Finder), Sign in with Apple, APNs. Apple Terms

We are not responsible for the availability, accuracy, or conduct of third-party services.

19. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Washington County, Arkansas.

20. Modifications

We reserve the right to modify these Terms at any time. Changes take effect when posted to this page. We will make reasonable efforts to notify you of material changes through the app or by email. Your continued use of Pour after changes are posted constitutes acceptance of the revised Terms.

21. Termination

We may suspend or terminate your access to Pour, with or without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. You may stop using the app at any time by uninstalling it. If you have an account, delete it from Settings to permanently remove all associated server data.

22. Severability

If any provision of these Terms is found unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

23. Entire Agreement

These Terms, together with our Privacy Policy and Apple's EULA (Section 14), constitute the entire agreement between you and Party On NWA LLC regarding your use of Pour and supersede any prior agreements or understandings.
